Texas Cottage Food Law

Bite Me Goodies operates under the Texas Cottage Food Law, which allows certain foods to be produced in a private home kitchen and sold directly to consumers. Recent updates expanded what cottage food producers may offer while keeping transparency and consumer safety front and center.

  • Effective September 1, 2025: Most foods are now allowed except for meat/poultry carcass products, seafood, ice or frozen desserts, low-acid canned foods, CBD/THC items, and raw milk products.
  • Annual sales cap: Increased to $150,000 per year and indexed for inflation.
  • TCS (Time/Temperature Controlled for Safety) foods: Require DSHS registration, production dates, safe-handling language, and temperature-controlled storage and delivery. These items may only be sold directly to the consumer.
  • Non-TCS foods: May be sold directly or through a registered Cottage Food Vendor (such as certain markets or retail partners).
  • Updated labeling language required:
    “THIS PRODUCT WAS PRODUCED IN A PRIVATE RESIDENCE THAT IS NOT SUBJECT TO GOVERNMENTAL LICENSING OR INSPECTION.”
  • Address privacy option: Home addresses may be omitted when registered with DSHS and replaced with a unique identifier.
  • No local permits or fees may be required solely to operate as a cottage food producer.

This food is made in a private residence that is not subject to governmental licensing or inspection.
